These General Terms and Conditions (hereinafter referred to as GTC) govern the relations between the company Alžbětiny Lázně, as, ID number: 26342421, VAT number: CZ26342421, with registered office at Smetanovy sady 1145/1, Karlovy Vary, zip code 360 01, registered in the commercial register of the Regional Court in Pilsen, section B, insert 968 as a provider of services (hereinafter referred to as the company) and a customer of services (hereinafter referred to as the customer), which result from the contract for the provision of services concluded between them, by purchasing the service in cash at the company's cash registers.
For the relationship between the company and the customer created in this way, these General Terms and Conditions will be used in the first place. The company provides customers with therapeutic procedures and procedures of a relaxing and therapeutic rehabilitation nature, in particular baths, hydrotherapy, massages, rehabilitation, heat treatment, electrotherapy, etc., and also enables customers to use the swimming pool, sauna, salt cave and other services, all in the company's headquarters in Karlovy Vary (place of service provision), when the list of services is given in the company's price list.
The customer is obliged to comply with the General Terms and Conditions and by purchasing the procedure/service expresses his agreement with these General Terms and Conditions.
1. Conclusion of the contract and the scope of the provision of services
1.1 The contract between the company and the customer is concluded at the moment of payment for the selected service (procedure, swimming pool, salt cave, promotional/seasonal packages, etc.) at any cash desk of the company at its headquarters.
1.2 The contract between the company and the customer is concluded for a fixed period, and this depends on the individual types of services ordered. Purchased services can be used for a maximum period of 4 months from the date of purchase, unless a different subscription period is specified, and in the case of a service purchased at a discounted price as part of a discount campaign, then only for the duration of this discount campaign, in which the customer is obliged to exhaust the services. In the case of using services by subscription, the period of their possible use is indicated on the relevant document (date of purchase of the service indicated on the receipt, date indicated on the card, voucher, voucher, etc.).
1.3 By paying at the cash register, the customer simultaneously confirms that the provision of the service will be carried out on the basis of common practices, rules for individual types of services, organizational and visiting rules of the company and these GTC, which he is obliged to follow and which are located and publicly accessible at the company's headquarters, where services are provided. Before purchasing the service, the customer is obliged to familiarize himself with all the rules for the type of service purchased, including the organization and visiting rules of the company.
2. Price of services
2.1 The price of services is governed by the company's current price list, which is publicly available at the company's headquarters and on the company's website www.spa5.cz. The prices of the services are paid in cash, or by payment cards, at the cash desks of the company at its headquarters. The price of the services is the final price, and the company will not charge any additional fees beyond it, subject to compliance with all conditions by the customer.
3. Failure to Provide Service
3.1 The company may refuse to provide a paid service in whole or in part if the customer is not qualified to provide the service and/or violates the rules, operating regulations, visitor regulations or other internal regulations of the company.
4. Complaints and cancellation fees
4.1 Complaints and cancellation fees are governed by the company's valid complaints procedure, which is located at every publicly accessible cash desk at the company's headquarters.
4.2 In the event of customer dissatisfaction with the services provided by the company, and if the dispute between the customer, who is a consumer, and the company cannot be resolved between them, the customer has, pursuant to Act No. 634/1992 Coll., on consumer protection, as amended regulations, the right to an out-of-court settlement of a consumer dispute from the contract. The materially competent entity for the out-of-court settlement of consumer disputes arising from a contract between the company and a customer who is a consumer is the Czech Trade Inspection. The website of the trade inspection is www.coi.cz.
5. Final Provisions
5.1 The company reserves the right to change and supplement these GTC. Possible changes and additions to the General Terms and Conditions will not apply to already concluded contracts, if in such case the concluded contractual relationship between the company and the customer is governed by the general terms and conditions for sales at the company's cash registers at the time of the conclusion of the contract between the company and the customer.
5.2 These General Terms and Conditions are considered in accordance with the provisions of § 1751 of Act No. 89/2012 Coll., Civil Code, as part of each individual contract and their complete and current wording is published by the company on its website www.spa5.cz.
5.3 In the event of a conflict between the language versions of these General Terms and Conditions, the General Terms and Conditions in the Czech language always take precedence
5.4 These General Terms and Conditions become valid and effective on May 1, 2024.
5.5 Starting from the effective date of these GTC, the previously issued general terms and conditions for cash sales at the company's cash registers shall cease to exist.
RULES FOR THE SALE OF INDIVIDUAL SERVICES
These rules apply to services provided by the company as a service provider based on the purchase of services (products) in cash at the company's cash desks. All services are provided by the company at the company headquarters in Karlovy Vary.
1. SUBSCRIPTION OF SERVICES - PROCEDURE PROVIDED
1.1 Subscriptions may be purchased
a) under the conditions posted on the company's website and at the cash desk - e.g. procedure packages
b) on the basis of various company promotions
c) as part of special company events announced in the media or on the company's website
d) within the contractual relationship between the company and its contractual partner, especially within the framework of reciprocity of services provided.
1.2 The subscription is valid for 4 months from its purchase at the company's cash register, i.e. from the date marked on the cash receipt and must be used up during this time. This does not apply to time-limited promotions, where the validity is limited by the duration of such promotion.
1.3 It is not possible to extend the validity of the subscription beyond its validity period according to paragraph 1.2.
1.4 The subscription is non-transferable, i.e. it can only be used by one natural person for the entire period of validity.
1.5 No other discounts can be applied within the framework of the use of subscription services. Discounts cannot be combined.
1.6 Other services (procedures) that are not included in the subscription can be purchased at regular prices according to the company's price list.
1.7 It is always necessary to pre-order the date of use of the purchased services (procedures) on a specific day and time at the company's headquarters in person, in writing, or by electronic means to the company's e-mail address info@spa5.cz. The possibility of drawing is governed exclusively by the company's operational possibilities, and the customer does not have the right to demand the drawing of the service on the date requested by him, if this is not possible for the company's operation.
1.8 Cancellation fees for canceling timed ordered procedures within the subscription are governed by the company's normal complaint procedure, i.e. they are usually 10%, if the procedure is canceled ahead of time, in case of cancellation on the day of the procedure, the cancellation fee is 100%, unless the doctor recommends cancellation.
1.9 If the value of the services (procedures) is not used up during the validity period, the unused amount is not returned, unless a doctor recommends a return for serious health reasons.
1.10 If the customer or the person to whom the service is to be provided does not appear on time, the procedure is forfeited.
2. SUBSCRIPTION SALT CAVES
2.1 The subscription is valid for 4 months from the date of purchase at the company's checkout, i.e. from the date indicated on the receipt. This does not apply to time-limited promotions, where the validity is limited by the duration of such promotion.
2.2 It is not possible to extend the validity of the subscription beyond its validity period according to paragraph 2.1.
2.3 The subscription is non-transferable, i.e. it can only be used by one natural person for the entire period of validity.
2.4 No other discounts can be applied within the framework of the use of subscription services. Discounts cannot be combined.
2.5 If the value of the services (procedures) is not used up during the validity period, the unused amount is not returned, unless a doctor recommends a return for serious health reasons.
2.6 If the customer or the person to whom the services are to be provided does not arrive on time on the agreed day and time, the procedure is forfeited.
2.7 The subscription includes 10 free entries, a specific entry must be reserved verbally or by phone in advance for a specific day and time. The possibility of drawing is governed exclusively by the company's operational capabilities.
3. POOL SUBSCRIPTION
3.1 The validity of the subscription is unlimited until the purchased minutes are used up.
3.2 The subscription is transferable, i.e. it can be used by more than one person, and only if the person using the subscription is in the same price/age range.
3.3 No other discounts can be applied within the framework of the use of subscription services. Discounts cannot be combined.
3.4 The subscription to enter the pool can be used during normal operating hours of the pool at the company's headquarters.
